A ballot foul-up has erupted in Mogadore.
A charter amendment on Tuesday's ballot omits language that the Village Council approved last spring.
The ballot language asks voters whether they want to change the number of charter commission members from eight to seven.
It does not address who appoints the charter commission's members.
Council's resolution proposed that the mayor appoint all the members. Currently, the mayor appoints four and the council appoints four.
A posting on the village's Web site says that because the language was omitted, current charter language concerning appointment of charter members would stand, regardless of Tuesday's vote.
Village Clerk-Treasurer Juliann McCulley said this is the opinion of Law Director Joel Reed. She said Reed inadvertently omitted the additional language.
Mike Berger, a candidate for Mogadore council, disagrees.
He said that if voters were to approve the issue, it would have the effect of stripping the charter of language addressing how charter commission members are appointed.
Reed could not be reached for comment.
Berger said village officials were advised by the Board of Elections in mid-September that there was still time to withdraw the issue from the ballot.
''It was surprising to find out that there was a chance to withdraw it and no decision was made,'' Berger said.
Now, he is urging voters to turn down the measure, making the matter moot.
''Whether you agree or disagree with the issue, voters need to see the complete issue,'' Berger said.
